A newly-acquired vehicle whose substantial defects persist even after several attempts to fix it is known as lemon. The law that aims to protect consumers from lemons is called Lemon Law. However, not all types of vehicles are covered by such law.

Some of the types of vehicles that are eligible under the Lemon Law are passenger cars, certain lightweight trucks, and motorcycles. Some vehicles that not covered by the Lemon Law are government vehicles, tractors and mopeds.


Laws that cover defective vehicles

1) The Magnuson-Moss Warranty Act

The federal law that is aimed at protecting buyers of any merchandise that has a written warranty is called the Magnuson-Moss Warranty Act. This law focuses on preventing producers or manufacturers from creating grossly unfair or unreasonable warranties. This act also enables warranty suits to be financially possible by providing the award of lemon law lawyers’ fees.

2) The Uniform Commercial Code

Most of the states in the US are covered by the Uniform Commercial Code. This law is applicable to the sale of goods and products. The UCC provides buyers rights to the replacement of lemon or refund of their money. Since this law does not give the definition of lemon, it is up to judicial bodies to decide whether the car company will provide car replacement or refund of the customer’s money. 3) Lemon Laws of different states

Lemon laws are usually state specific. You will find that North Carolina lemon law is slightly different with that of NJ lemon law. However, lemon laws of most of US states stipulate that a car manufacturer should replace or give refund for a defective new car in the presence of a safety problem or a significant defect that is not fixed even after a specified number of attempts to do so, or if the car was out of service for a particular period.
