As stated in the Vehicle Code, Section 1 23152, it is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.

On the other hand, minor DUI offenses may involve fine, restriction, suspension of license or vehicle, attending DUI school or in some cases, time spent in jail.

DUI IN CALIFORNIA

Fine for the first offense of DUI in California costs around 390 to 1,000 dollars plus penalty assessments. License suspension may reach up to 4 months or if the offender is under 21 years of age, license may be suspended up to a year. Time spent in jail must be 48 hours but not more than 6 months; and the court may order vehicle impoundment. Alcohol education in DUI School is mandatory if the offender is under 21 years old. The offender may also work off some of her fees by doing community service.

DUI IN MARYLAND

In Maryland, the BAC (blood alcohol concentration) level is lowered. Therefore, it is easier to get caught for drunk driving. Maryland DUI penalties include a minimum driver's license suspension of 45 days, fine of up to 1,000 dollars and a year in jail for the first offense, and for the second offense, fine for up to 2,000 dollars and up to 2 years in jail.
