Medical malpractice results from the errors made by doctors, or other medical professionals in providing treatment to their patients. These mistakes result in serious injuries, and some even result in death.

Medical malpractice can occur in various ways. These include, but are not limited to: diagnosing an incorrect illness, prescribing the wrong medication, failing to diagnose an illness that becomes a threat to someone’s life, performing incorrect surgical procedures, and many more.

If you have sustained serious or permanent injuries as a result of a doctor’s incorrect treatment, you may file a malpractice case with the help of a medical malpractice lawyer.

A good medical malpractice lawyer is someone who is familiar with medical terms and procedures. Malpractice lawyers need a large amount of money in order to defend your case. A medical malpractice attorney should be able to discuss your case with you, and only charge a professional fee after the case is won, regardless of the period it took to win your case. If your case is lost, then there is no need to pay the lawyer anything.

There are two major factors that a medical malpractice lawyer considers before accepting your case. The first factor is finding out whether the estimated amount of money that could be awarded to you will be sufficient to cover your legal expenses. Legal expenses include hiring expert witnesses, fees to obtain medical records, and the like.

The second factor that a malpractice attorney will consider is whether your case can be proven. There are three things that must be present in order for your case to be proven. You must be able to clearly show proof that negligence was performed by the medical professional, which resulted in your injury. You will need to find an expert witness such as another doctor to testify and demonstrate that your injuries were a result of an incorrect procedure, or incorrect treatment. Injuries can include death, salaries that were lost, mental suffering, anguish and any physical injuries.

The third factor relates to being able to show causation; or, in other words, that the doctor was guilty of making that medical mistake.

In choosing a malpractice lawyer, you should choose someone with whom you feel at ease with. You must be able to provide your malpractice attorney with complete and true information, even if it will hurt your case, so that you can be defended properly. Your malpractice attorney should be able to tell you the truth about your case, and not how you wish the case would turn out. Find out how much time a malpractice attorney will spend on your case, and whether your case will be assigned to someone else in the firm. Finally, and most importantly, try to find out whether the professional fee that will be collected will be a gross amount (before legal and miscellaneous expenses are deducted), or net amount of the amount awarded to you.
