K 1 Fiance Visa – Know The Requirements To Be Eligible

A K 1 fiance visa will allow you to enter the country to get married. To be eligible for a K 1 fiance visa, your intent to live permanently after your marriage is not necessary. The visa rewards you with the option to stay and apply for a green card after your marriage.

In order to be eligible for fiance visas or fiancee visas, the law requires that you meet the following criteria:

• You must intend to marry a citizen of the country;
• You have met your intended spouse in person within the last two years except in cases based on cultural customs or extreme hardship; and
• You are legally free to marry.

You shouldn't apply for a K 1 fiance visa if you don’t have plans to marry. But you must take note that the government requires some proof of the impending marriage. You need to provide actual plans of the wedding (such as a place, date, type of ceremony or proceedings). And you have to make sure that your intended spouse is a citizen, not just a permanent resident or green card holder, of the country.

Because there are a number of couples falling in love over the Internet, or even through old-fashioned letter writing, and to protect against bogus marriages, the law requires that you and your spouse-to-be have actually met in person within the last two years. You must schedule to meet your intended spouse at least once before applying for a K 1 fiance visa.

You must not be underage (below 18 years old), legally married or related by blood to your intended spouse to be eligible for a K 1 fiance visa. However, there are some states that allow underage marriage as long as you can show your parents’ consent. And if you have been previously married, you must also present proof that such marriage was legally terminated.
