A legal process server ensures the delivery of legal notices including summonses, complaints, petitions, writs and subpoenas. A process server, which directs the recipient to perform certain tasks according to the court regulations.

In some states, a private process server must be registered and/or licensed in the county where the individual resides. In some states such as California, California process servers have the authority to serve legal notices to individuals residing in any county within the state of California. In other counties, private process servers can only deliver legal documents within the county where the process server resides or is registered.

Private process servers are the most reliable individuals to approach when there is a need to serve legal papers. These individuals are knowledgeable in the rules and laws of your county. Most have likely attended some form of formal education to become process servers.

There are other types of legal process servers:

Your local county sheriff, constable or marshal can also act as a legal process server. In the past, these officials were the most common choice for legal process servers. Today, these officials are not as reliable in serving your legal papers. These officials have more pressing matters to attend to, and thus your papers may end up being unserved.

Detectives and private investigators also have the authority to become legal process servers without obtaining a license to do so. You must choose your detective/investigation agency wisely as some of these agencies take a long time in serving legal papers.

There is a limit on the number of legal documents that a private process server can deliver, and this differs in every state.

When choosing a private process server, ensure that you check with your local business bureau for any information on the company. The price that is charged should not be the main criteria for your selection, but whether the task can be done efficiently. You should also inquire about any additional fees that may be charged aside from the service fees. Some companies charge incidental fees on various operational expenses.
