Under Arizona Divorce Law, a court process is required to legitimately end a marriage. This process is called "Dissolution of Marriage.” Aside from legally putting an end to the marital union, the decree of divorce may also cover property relations as well as the division of debts between you and your spouse. AZ Family law is also covered by such procedure because the divorce encompasses resolution of custody and child support in case you have children.
In order to get a decree of divorce in AZ, at least one of you should have resided in the said state for 90 days prior to the filing of the petition for the dissolution of marriage.
It does not take too long to get divorced in Arizona. If your spouse is in default or does not respond, it takes about 90-100 days. If you agree on everything, it takes about 70-75 days. However, if you or your spouse files a response contesting any of your claims or demands, then it may take several months or longer.
If you are the Petitioner – or the one seeking divorce – you only need to go to Court for a two-minute hearing. Arizona divorce laws allow you to represent yourself in court. This means, you may choose not to have an attorney. If you and your spouse agree by stipulation and you have no contests whatsoever, you can get a divorce even if both of you do not appear in court.
If your spouse contests the divorce, you will have to take additional steps in order to get the decree. This is because Arizona is a “no fault” state. Meaning, it is required that the marriage be “irretrievably broken” before a divorce can be decreed.
If you have children, the issue of child support shall be tackled by the proceedings as well. It is primarily determined by he Arizona Child Support Guidelines. This would include the determination of your respective incomes as parents, necessary expenses for your offspring, alimony, and at present, the amount of time your child shall spend with whoever shall end up as the non-custodial parent. Child support shall be paid through the State Clearing House. You or your spouse may file for a raising or lowering of the value of child support when your circumstances warrant the same. Arizona Custody laws allow such modifications.
Arizona divorce is one of today's simplest state laws on marriage dissolution in the country.
