Criminal Lawyers: Guilty or not Guilty

Criminal lawyers are legal representatives who specialize in the trail and defense of criminal offenses. Criminal laws are different from civil law in the sense that civil law involves lawsuits between two parties; whereas in criminal offenses, the crime is believed to have been committed against society or state as a whole.

OFFENSE OR DEFENSE

Criminal lawyers may either be persecutors – these lawyers file the cases and act on behalf of the state as the complainants. Defense attorneys are also criminal lawyers but they act in defense of the accused. These criminal defense lawyers must defend their clients regardless whether they have committed the alleged crime or not.

Both of these types of criminal lawyers are obliged by law to hold their respective parties’ interest with utmost regard. They are bound by their oath of office to represent their clients to the best of their means and abilities. Failure to do so can result in penalties; even disbarment.

Criminal trials are bound by the variation in laws and jurisdictions which are very different from state to state. Some places uphold capital punishment, while others do not. That is why the capabilities required of Houston criminal lawyers will be different from those asked of Dallas criminal lawyers or San Diego criminal lawyers.

THE BURDEN OF PROOF

Some criminal defense lawyers will even go to great lengths to change the venue of the case to where punishments are less severe or more sympathetic to criminals. However, most of the time, the trial will be held in the state where the alleged crime took place and will be localized to that state. But if the accused or suspect has crossed states in escape of the law, this will involve federal jurisdiction and will call for a federal criminal lawyer.

Criminal trials are divided into two main parts - the first is the presentation of the case by the persecution side; after the persecution rests, the defense can now ask for a dismissal of the case if they believe the persecution failed to make their case or present their defense arguments.

Whether a suspect guilty or not guilty is actually a judgment call; but either way, criminal lawyers are a necessity of modern, civilized society.
