Everywhere we go we run the risk of being injured or inflicting injury to others. These are daily hazards that we must contend with

INTENTIONAL OR NEGLIGENT

Injury as a general definition is an impairment to a bodily part or function caused by some external force or instrument whether by deliberate action, accident, or negligence. An injury may be minor and superficial and does not require any medical attention at all. Another injury may be extensive and one that may require long hospitalization and treatment and even permanent handicaps.

Because injury is seldom self-inflicted, an outside agent is most likely to have caused it. Often a second party is involved, and he or she will be liable under the law to pay you damages if proven to be the one at fault for bringing about the injury – whether by sheer intent or carelessness.

JUST DUES

Injury caused by intention means that the person meant to hurt you – it was a deliberate action on your part that caused harm. Negligence on the other hand means that while it was not your purpose to hurt, some actions you have taken or failed to take led to the injury taking place. It means that you have some control over the circumstances that caused the injury but failed to prevent it from happening because of an oversight on your part. It is worth mentioning though that injury at work is a different scenario altogether. Some types of work are hazardous in nature. In this case employees are covered by an injury insurance that guarantees them compensation if an injury occurs while dispensing the duties of their job. Usually there is an accompanying waiver that frees the employer from any legal obligation apart from the benefits that was provided in the insurance coverage. But of course, this is a case-to-case basis, and in some instances the waiver might be disputed depending on the extent and nature of the injury that took place.
